Criminal Law

Mr. Davis has practiced criminal law since 1983 and is versed in all areas of the law. He is a former President of the Nassau County Criminal Courts Bar Association and a former Director of the Nassau County Bar Association. He practices in all the state courts of New York and is admitted to the Federal Courts of the Eastern and Southern Districts of New York, the Court of Appeals for the 2nd Circuit and the US Supreme Court.

ALCOHOL AND VEHICLE CRIMES
Mr. Davis has represented clients on all charges emanating from drinking and/or drug use and driving. These include felony and misdemeanor charges of Driving While Intoxicated (DWI); Driving While Impaired by Drugs; Driving While Cross-Impaired by Drugs and Alcohol. He also has handled vehicular manslaughter and assault, reckless driving, leaving the scene of an accident, and other vehicular-related crimes. The local DA’s Offices continue to make their policies tougher including the request for jail time on even first time offenders.

Mr. Davis has tried numerous “DWI” cases and has represented clients at the Department of Motor Vehicles on Refusal Hearings. Mr. Davis has lectured on these subjects at the Nassau County Bar Association and keeps up to date on this ever changing area of the law.

PENAL LAW CRIMES AND VIOLATIONS
Mr. Davis has represented clients on virtually all charges from the most serious of Murder, Burglary, Robbery, Drug Sales and Possession, Assaults to misdemeanors of Possessing Stolen Property, Unauthorized Use of a Vehicle, and Petit Larceny. He is fully versed in the policies of all the District Attorneys’ Offices in the metropolitan area. Besides having the ability to represent his clients in court, he also knows how to assist his clients in seeking solutions to their individual problems, whether it be alcohol, drugs, or psychiatric issues. Mr. Davis is the chairman of the Nassau County Bar Association’s Lawyers Assistance Program, which helps lawyers with such problems. One of the keys to obtaining excellent results is often finding the client the help he/she needs and presenting this to the Court and the DA in a positive way, as an alternative to incarceration.

DOMESTIC VIOLENCE
Whether the charge is a felony or misdemeanor, emanating from Domestic Violence, including violations of Orders of Protection, Mr. Davis has handled all such cases. Domestic Violence also can result in Family Offense Petitions being filed in Family Court, and Mr. Davis handles those cases as well. Currently, if a 911 call is made for Domestic Violence in New York, the police will make an arrest if  evidence of violence is observed, and even if the other party does not want an arrest to be made. These are highly emotional cases that can affect other areas including child custody and other aspects of a matrimonial case.
